You mean, if Broyles had a Loyalist tattoo on his face? I don't recall seeing any.
In any case, Broyles is certainly no Loyalist, and his oversight of Fringe Division has been allotted by the Observer higher-ups because they need him.
Wasn't the Loyalist tattoo required? It's going to be hard to catch with the age make-up......

The Loyalists were a group of humans who decided to join sides with the Observers instead of opposing them during the 2015 uprisings incited by the Invasions.
However, it was explained that the Fringe team tried to fight the Observers (but failed). Broyles, being the head of the Fringe Division, invalidates his association to the Loyalist faction. However, the Observers decided to keep Fringe Division operational so as to police Natives and Native-on-Native crime, so Broyles does work for the Observers, but only begrudgingly. Only those who openly and fully serve the Observers of their own will are Loyalists, and are those branded with the tattoos on the cheek (like the Gestapo fellas, for instance).

IDK sounds like an excuse for Broyles to really be an Observer spy...dun dun dun.
